Article 1 - A BRIEF ABOUT OUR PLATFORM

Peata is a Web Portal and Mobile App platform, (hereinafter “Platform”) developed and owned by Peata Application For Pets, having its business address as 3066 Altahliah St., Riyahd, 13515, Saudi Arabia, it is a marketplace aiming to provide a Platform for the Product and Service Seekers and the Product and Service Providers to connect with each other for the ease of needs and deliverables of requirements, the Product and/or Service seekers can easily purchase the products and avail the services pertaining to Pets. Pet products includes but not limited to food items, accessories etc and services includes but not limited to grooming, shower, clinical appointments, doctors visits, and pet setting etc. The service providers on our platform sell their reliable and excellent products and services which the users may avail from our platform.

Peata services are intended to provide the customers with the best of the products and services they need with the ease of a few clicks and typing in their requirements, the service seeker just needs to sign up with their details and choose the category of products and services they want for their requirements and selecting the service providers contacting them for their requirement fulfillment.

Peata Application For Pets provides a platform for the service seekers to find trustworthy products and service providers around them through its online platforms getting their work done effortlessly and within a stipulated period. Peata Application For Pets puts in their efforts to provide the best service providers to the service Seekers on its platform.   

Peata is intended to be a compliment to the existing system and services for day to day needs, it enables the individuals to make their work super easy and fast avoiding the need of finding the products and service providers manually by going to the market saving time and energy with getting the best of products and service providers.

Article 2 - THE AGREEMENT

The use of our services are provided by our webs based and Mobile App based platforms available on Google play for android users and Apple App Store for its registered users and are subject to the following Terms and Conditions (hereinafter the "Agreement"), all parts and sub-parts of which are specifically incorporated by reference here. This Agreement shall govern the use of all the pages on the Peata website and mobile application (hereinafter collectively referred to as "Platform") and any product and services provided by or on the Peata Platform through our service providers.

Article 3 - DEFINITIONS

The parties which have been referred to in this agreement are: Peata Application For Pets, Us, We: Peata Application For Pets as the creator, operator, and publisher of the website and mobile application, developed and owns the Platform, we provide the services through and for its registered users who avail the services and products from our service providers based on their needs through our Platform. Peata Application For Pets, Us, We, Our, Ours and other first-person pronouns will refer to Peata as well as all the employees of Peata Application For Pets.

You, being the User and the Client will be referred to as You, Your, Yours, User, Service Seekers or as Client in this agreement.

The Vendors offering and selling their products and services will be referred to as the Service Provider.

The parties to this Agreement (Peata Application For Pets, and You) will be referred to as Parties.

Article 4 - ACCEPTANCE

By using the Peata website and mobile application, you warrant that you have read and reviewed this Agreement and that you are bound by each of its clauses governing the use of this Platform. If you do not agree to be bound by this Agreement, please hold the use of the Peata Platform. Peata Application For Pets only provides use of its Platform content and Services to you if you assent to this Agreement.

Article 5 - RESTRICTIONS

You must be at least 18 (eighteen) years of age to use this Platform its content or any Services contained herein. By using this Platform, you represent and warrant that you are at least 18 years of age and legally agree to this Agreement. Peata Application For Pets assumes no responsibility or liability for any misrepresentation of your age.

Article 6 - LICENSE

Peata provides you with certain information as a result of your use of this Platform its content or Services. Such information may include but is not limited to, documentation, data, or information developed by Peata and their registered users. Materials which may assist in your use of the Platform products or its Services Subject to this Agreement, Peata grants you a non-exclusive, limited, non-transferable and revocable license to use this Content and services solely in connection with your use of the Platform. Peata Content shall not be used for any other purpose, and this license terminates upon your cessation of use of the Platform its content or Services or at the termination of this Agreement.

Article 7 - INTELLECTUAL PROPERTY

You agree that the user-generated content on the Platform and all Services provided by Peata are the property of Peata Application For Pets, All copyrights, trademarks, patents, and other intellectual property belongs to ("Peata Application For Pets ") or its licensors. You agree that Peata Application For Pets owns all right, title and interest in and to the platform and that you will not use Peata for any unlawful or infringing purpose. You agree not to reproduce or distribute Peata Application For Pets IP in any way, including electronically or via registration of any new trademarks, trade names, service marks or Uniform Resource Locators (URLs), without express written permission from the owners of Peata Application For Pets.

Article 8 - USER REGISTRATION AND ACCOUNT SERVICES

As a user of the Platform, You are asked to register with us. When you do so, you will be asked to provide your personal information, including, but not limited to, your name, contact number, email id, physical address, and in addition to this, documents like Passport, Driving License in case if you are a service provider on the platform. You are responsible for ensuring the accuracy of this information. This identifying information will enable you to use the Platform its content and Services. You must not share such identifying information with any third party, and if you discover that your identifying information has been compromised, you hereby agree to notify us immediately by writing an email to us, you are responsible for maintaining the safety and security of your identifying information as well as keeping us apprised of any changes to your identifying information. Providing false or inaccurate information, or using the Platform or Services to further fraud or unlawful activity are grounds for immediate termination of this Agreement

Article 11 - RELEASE AND HOLD HARMLESS

You as a service seeker and service provider agree to defend and indemnify Peata Application For Pets, its owners, partners, employees, contractors, agents and any of its affiliates and hold us harmless against any and all legal claims and demands, including reasonable attorney's fees, which may arise from or relate to the products or services Provided or obtained by the use of Peata Platform its content or Services, your breach of this Agreement, or your conduct or actions.  

Though Peata Application For Pets takes enough and ample steps for the screening to make sure the service providers are properly registered, have an office, and check the proof of their professionalism and skills, but we does not accept responsibility for the products/services or transaction performed by any of the service provider or the service seeker. You agree that your use of the Platform its content or Services is at your own risk and you agree to release, hold harmless and indemnify Peata Application For Pets from any legal or moral liability.

No guarantee or warranty of any kind either to the service seeker or services provider as a user of Peata online platforms is provided in any form from Peata Application For Pets. The users must apply their minds while providing or receiving the services.

The Products or service warranty shall be governed by the respective manufacturers and the service providers, Peata Application For Pets disclaims and all kind of liabilities pertaining to the products and/ or services purchased from the platform.

Article 12 - MODIFICATIONS 

Peata Application For Pets, from time to time and at any time without notice to you, may modify this Agreement. You agree that Peata has the right to modify this Agreement and its Platform content and services or revise anything contained herein. You further agree that all modifications to this Agreement are in full force and effect immediately upon posting on the Platform and those modifications or variations will replace any prior version of this Agreement unless prior versions are specifically referred to or incorporated into the latest modification or variation of this Agreement.

To the extent any part or sub-part of this Agreement is held ineffective or invalid by any competent court of law, you agree that the prior, effective version of this Agreement shall be considered enforceable and valid to the fullest extent.

You agree to regularly monitor this Agreement and refer to the Effective Date posted at the bottom of this Agreement to note any modifications or variations. You further agree to clear Your cache when doing so to avoid accessing a prior version of this Agreement. You agree that your continued use of the Platform after any modifications to this Agreement is a manifestation of your continued assent to this Agreement.

If you fail to monitor any modifications to or variations of this Agreement, You agree that such failure shall be considered an affirmative waiver of your right to review the modified Agreement.

Article 14 - TAXES 

Service providers are responsible for assessing and carrying out their legal requirements to record, collect, pay, or include in your price any relevant VAT or other indirect taxes, such as occupancy taxes.

Where Peata App for Pets allows Tax collection and/or remittance on behalf of Service Providers, the Service Providers instruct and authorize Peata App for Pets to collect and/or remit Taxes on their behalf to the applicable Tax authority. Taxes collected and/or remitted by Peata App for Pets are clearly identified to Members on their transaction records, when applicable.

In the event that the Taxes collected and/or remitted are insufficient to fully discharge that Member's tax obligations, Peata App for Pets may seek additional amounts from Service Providers, including by deducting such amounts from future payouts, and they agree that their sole remedy for Taxes collected by Peata App for Pets is a refund from the applicable Tax authority.

Tax regulations in certain jurisdictions may require Peata App for Pets to collect and/or report Tax information about Service Providers, withhold Taxes from payouts, or both. If Service Providers fail to produce paperwork that Peata deems sufficient to support any such duty to withhold Taxes from payouts to Service Providers, we may withhold reimbursements up to the amount required by law until adequate documentation is given. You agree that Peata App for Pets may issue invoices or comparable documents for VAT, GST, consumption, or other Taxes for your Services on your behalf in order to assist proper tax reporting by Service Providers, our Clients, and/or their organizations.

Article 15 - CANCELLATION AND REFUND

In general, if a Client cancels an order, the amount paid to you is set by the order's cancellation policy. Service providers should not cancel an order unless there is a valid reason or if the law requires it. If Service Providers cancel without a good reason, Peata App for Pets reserves the right to charge a cancellation fee. If an order is cancelled, the amount paid to Service Providers is reduced by the amount we refund or otherwise return to the Clients, as well as any other reasonable costs we incur as a result of the cancellation.

If a Client receives a refund after Service Providers have already been paid, or if the amount of the refund and other costs incurred by Peata App for Pets exceeds the payout to Service Providers, Peata App for Pets may recover that amount from Service Providers, including by offsetting the refund against future payouts.

Service Providers and Clients agree to pay any additional amounts, fees, or taxes associated with any Booking Modifications they agree to make via the Peata App for Pets Platform or direct Peata App for Pets customer service to make on their behalf, and agree to pay any additional amounts, fees, or taxes associated with a Booking Modification.

We are committed to provide you with the best of our services and products fulfilled through our leading service providers for your satisfaction and focus on building a strong and long-term relationship with you.

If at any time you find our products or services provided to you not satisfactory, you may request an order cancellation. We expect you to read all the terms and conditions and other related documents before purchasing any of the products and services.

The clients are requested to purchase the products and services after making sure of their service or product requirement they are purchasing, Peata Application For Pets will not be able to process the cancellation once the products or services are purchased.

Most of the services and products cannot be returned or cancelled, therefore requests to do so will be assessed on a per-item basis with no guarantee of return or cancellation.

Custom products and services like grooming, clinical services, and boarding services cannot be cancelled or refunded.

Partial refunds may be provided to the client after the cancellation request acceptance.

If refunds are approved, they will be issued in the same form of payment and in the relevant account (credit or debit card) from which it was originally paid within three to seven days.

While putting forward the Client must mention the reason for the cancellation and/or refund

Article 16 - SHIPPING

In the event, the Client seeks services or products from more than one Service Provider each order shall be placed separately.

For each order, the Client shall be responsible for selecting the preferred shipping company from the list provided on Peata App for Pets and accept the shown applicable charges.

A tracking id number along with the approximate delivery timings will be provided to the Client after shipping of the products.

Shipping Fees is non-refundable, the Client will be responsible for the payment of shipping fees for each order.

Peata App For Pets may not control the courier to handle your shipment safely. A third party carrier ships the parcel.

Any damaged product or missing parcel should be reported within 7 days of the receipt or non-receipt of the parcel with the relevant photo showing the damage of the products to the Service Provider.

After the successful review of the damaged product by the Service Seekers, the Client will be issued with a replacement upon the Service Provider’s satisfaction; any package damage will not be counted as the product damage.

All the replacement shall be at the discretion and approval of the Service Provider.

Article 17 - ADVERTISEMENTS AND APP

The facility of advertisements are provided through the social media platforms, SMS and e-mail marketing for the service provider which will be chargeable as per the applicable fee structure decided by Peata Application For Pets.

Article 18 - LISTINGS

The Service Provider will be provided with a separate web based and mobile based application platforms through which an exclusive account shall be created for the listing of products and services of the Service Providers.

All the business transactions including the payment of the service provider will be done through the Service Provider’s web based and mobile based application platforms.

An exclusive login ID will be created for the Service Provider for which the Service Provider will be responsible to maintain the security and safety to their account.

Peata App for Pets grants you permission to utilize the Peata App for Pets Platform to share your products and services while earning money. It's simple to establish a Listing, and you have complete control over the price, availability, and rules for each Listing.

When you accept a booking request or receive a booking confirmation via the Peata App for Pets Platform, you are entering into a direct contract with the Clients and are responsible for performing your Service in accordance with the terms and price mentioned in your Listing. You also agree to pay any applicable fees, such as the Peata App for Pets service fee (and any applicable taxes), for each booking. Unless we and you agree otherwise, Peata App for Pets Payments will deduct sums owed from your payout. Any terms, policies, or conditions you provide in any supplemental contract with Clients must: (i) be consistent with these Terms and the content in your Listing; and (ii) be clearly disclosed in your Listing description.

Article 19 - MANAGING THE LISTING

Peata App for Pets Platform offers features that make it simple to create and manage a Listing. Your Listing must contain complete and accurate information about your Service, your price, any additional costs, and any regulations or requirements that apply to your Clients or Listing. You must maintain your Listing information and content up to date and accurate at all times.

You are responsible for knowing and following any laws, rules, regulations, and third-party contracts that apply to your Listing or Services. The Services you seek to provide may be illegal in some areas. Check your local regulations to see what requirements apply to the Services you intend to provide. We provide legal requirements information for informational purposes only, and you should independently confirm your duties. You are responsible for managing and using Clients' and others' personal data in accordance with applicable privacy laws and these Terms. If you have any concerns about how local laws relate to you, you should always get legal counsel.

The ranking of Listings in search results on the Peata App for Pets Platform is determined by a number of factors, including the following: • Clients search parameters; • Listing characteristics such as price, calendar availability, number and quality of images; Reviews, type of Service, age of the Listing, average Clients popularity; • Clients booking experience such as customer service and cancellation history, ease of booking);

Search results on our mobile application may differ from those on our website. Peata App for Pets may charge a fee to promote their Listings in search or elsewhere on the Peata App for Pets Platform. More details on the aspects that influence how your Listing shows in search results, as well as our current promotional activities.

The Service Providers are responsible and liable for your own acts and omissions, as well as those of anybody they enable to engage in delivering Services. Service Providers are in charge of defining their own prices as well as creating the criteria and standards for Listing. Service Providers must mention all fees and charges in the Listing description and are not permitted to collect any additional fees or charges outside of the Peata App for Pets Platform. Do not encourage Clients to create third-party accounts, post reviews, disclose contact information, or engage in other activities outside of the Peata App for Pets Platform that violate our terms and conditions.

If Service Providers act as part of a team, business, or other organization, the entity and each individual involved in delivering Services are both responsible and liable under these Terms. When Service Providers accept conditions or enter into contracts, they represent and warrant that they have the authority to enter into contracts on behalf of and bind their team, business, or other organization, and that each entity they utilize is in good standing under the laws. If Service Providers execute additional responsibilities, they represent and warrant that they are permitted to do so. The Service Provider is accountable for the payment amounts and the accuracy of any payout information provided.

Article 20 - REMOVAL POLICY

If we receives a complaint and has reasons to believe that any of the service providers cheat, misbehaved or provided a lower standard of products and services to the service seekers and in breach of this or any other agreement by Peata. We reserve the right to remove that service provider from the our platform and bar them for using the platform for lifetime, A notice of such information may be sent by any user to Peata Application For Pets containing the description of the complaint/information with their contact details.

Article 21 - SERVICE INTERRUPTIONS

We may need to interrupt your access to the Platform to perform maintenance or emergency services on a scheduled or unscheduled basis. You agree that your access to the Platform may be affected by unanticipated or unscheduled downtime, for any reason, for which we shall have no liability for any damage or loss caused as a result of such downtime.

Article 22 - ASSUMPTION OF RISK

Service Providers accept the inherent risks of providing services and agree to bear the whole risk arising from their access and use of the Peata App for Pets Platform, offering Services, or any interaction they have with other users, whether in person or online. Service Providers affirm that they have investigated the Peata App for Pets Platform as well as any laws, rules, regulations, or requirements that may be applicable to their Listings or Services, and that they are not relying on any legal statement made by Peata App for Pets.

Peata App for Pets explicitly disclaims any, damage, injury, loss or harm incurred to the pets, as a result of any act or omission of the Service Providers, employees, contractors or agents related to the services rendered under this Agreement or any transaction or matter connected with the Services or the relationship between the Service Provider and Client

Article 23 - TERMINATION

We may terminate this Agreement with you at any time for any reason, with or without cause. Peata Application For Pets specifically reserves the right to terminate this Agreement if you violate any of the terms outlined herein, including, but not limited to, violating the intellectual property rights of Peata Application For Pets or a third party, failing to comply with applicable laws of the Kingdom of Saudi Arabia. If you have registered for an account with us, you may also terminate this Agreement at any time by contacting us and requesting deletion of your account. At the termination of this Agreement, any provisions that would be expected to survive termination by their nature shall remain in full force and effect.

Article 24 - WARRANTIES

You agree that your use of the Platform its content and Services is at your sole and exclusive risk and that any Products and/or Services provided or availed by you are on an "As Is" basis. Peata Application For Pets hereby expressly disclaims all express or implied warranties of any kind, we make no warranties that the Platform its content or Services will meet your needs, we do not warrant that the Platform its content or Services will be uninterrupted, error-free, or secure. Peata Application For Pets also makes no warranties as to the reliability or accuracy of any information and content on the Platform provided by the Service Provider. You agree that any damage that may occur to you, from your use of the Platform, products and its Services provided or obtained is your sole responsibility and Peata Application For Pets is not liable for any such damage or loss.

Article 25 - LIMITATIONS

Peata Application For Pets is not liable for any damages that may occur to you as a result of your use of its Platform the products or Services sold, to the fullest extent permitted by law, the maximum liability of Peata Application For Pets arising from or relating to this Agreement is limited to the greater of the amount you paid for any product and/or services to Peata Application For Pets through its platforms. This section applies to all claims by you, including, but not limited to, lost profits or revenues, consequential or punitive damages, negligence, strict liability, fraud, or torts of any kind.

Article 26 - JURISDICTION

Through Your use of the Peata Platform and its Services, You agree that the laws of the Kingdom of Saudi Arabia shall govern any matter or dispute relating to or arising out of this Agreement, as well as any dispute of any kind that may arise between you and Peata Application For Pets.

Article 27 - DISPUTE RESOLUTION

In case of a dispute between the Parties relating to or arising out of this Agreement, the Parties shall first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, the Parties shall then submit the dispute to the court of law.

Article 28 - ASSIGNMENT

This Agreement, or the rights granted hereunder, may not be assigned, sold, leased or otherwise transferred in whole or part by you. Should this Agreement, or the rights granted hereunder, be assigned, sold, leased or otherwise transferred by Peata Application For Pets, the rights, and liabilities of Peata Application For Pets will bind and inure to any assignees, administrators, successors, and executors.

Article 29 - SEVERABILITY

If any part or sub-part of this Agreement is held invalid or unenforceable by a competent court of law, the remaining parts and sub-parts will be enforced to the maximum extent possible. In such condition, the remainder of this Agreement shall continue in full force.

Article 30 - RELATIONSHIP 

No agency, partnership, employment or joint venture has been created between the Parties and/or between Peata Application For Pets and users as a result of this Agreement.

Article 31 - ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the Parties concerning all the use of our Platform. This Agreement supersedes and replaces all prior or contemporaneous agreements or understandings, written or oral, regarding the use of our Platform.
